South Africa Urges ICJ to Declare Israeli Occupation of Palestinian Territories Illegal

 

South Africa made a compelling plea on Tuesday at the International Court of Justice (ICJ), urging the tribunal to issue a non-binding legal opinion declaring the Israeli occupation of Palestinian territories as illegal. The South African representatives, in their opening statements on the second day of hearings at the ICJ in The Hague, emphasized the importance of such a declaration in advancing efforts toward a settlement in the region.

 

The hearings come in response to a request from the United Nations General Assembly in 2022 for an advisory opinion on the legality of the occupation. Over 50 states are set to present arguments until February 26th.

 

Yesterday, Palestinian representatives urged the ICJ to declare Israel's occupation of their territory illegal, highlighting that the court's advisory opinion could contribute significantly to a two-state solution and lasting peace. Notably, Israel opted out of attending the hearings but provided a written statement, expressing concerns that an advisory opinion could hinder negotiations with the Palestinians.

 

South Africa's ambassador to the Netherlands, Vusimuzi Madonsela, stressed the critical role of a clear legal characterization of Israel's regime over the Palestinian people in remedying ongoing delays and achieving a just settlement. The recent escalation of violence in Gaza, spurred by attacks in Israel by Hamas, has further complicated the situation and underscored the urgency of finding a viable path to peace.

 

The ICJ's panel of 15 judges has been tasked with reviewing various aspects of Israel's occupation, including settlements, annexation, and discriminatory measures. The outcome of the hearings, expected to be delivered in approximately six months, will have far-reaching implications for the legal status of the occupation and its consequences.

 

As tensions persist in the Middle East, the world watches closely as the ICJ deliberates on this crucial matter that could shape the future of the region and impact international efforts towards peace and stability.
