SAG-AFTRA Files Unfair Labor Practice Charge Against Epic Games Over Fortnite's AI Darth Vader

SAG-AFTRA has filed an unfair labor practice charge against Epic Games, accusing its subsidiary, Llama Productions, of using AI to replicate Darth Vader’s voice in Fortnite without negotiating with the union. The complaint centers on the game’s new feature where players can interact with an AI-powered Darth Vader NPC that speaks in a voice modeled after the late James Earl Jones. While his estate approved the use, SAG-AFTRA claims Epic failed to notify or consult the union, calling it a “unilateral change” that bypasses their right to bargain.

 

“We must protect our right to bargain terms and conditions around uses of voice that replace the work of our members,” the union said, noting that performers had previously been hired to mimic Darth Vader's iconic tone for other projects. Though SAG-AFTRA supports members choosing to license their voice or likeness, it emphasized the need for union involvement in these decisions. The charge against Epic Games comes amid a months-long strike by video game performers over unresolved AI contract terms.

 

Fortnite players have quickly discovered ways to make the AI Vader swear in voice chat, prompting Epic to issue a patch. Despite the technical novelty and support from Jones’ family—who said he “always wanted fans of all ages to continue to experience” the character—SAG-AFTRA argues this sets a dangerous precedent if companies replace union work with AI without transparency or accountability.
